By accessing or using the website at peruconcrete.com (the "Site") or by requesting or receiving services from Peru Concrete, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Site or our services.
These Terms apply to all visitors to the Site and to all customers who engage Peru Concrete for concrete contracting services. We reserve the right to update these Terms at any time by posting a revised version on this page.
Peru Concrete is a concrete contractor based in Peru, IN, providing concrete construction and related services to residential and commercial customers in north-central Indiana. Our services include, but are not limited to, driveway installation, patio construction, sidewalk building, foundation work, and other concrete and masonry services as described on the Site.
The Site is provided for informational purposes and to facilitate contact with potential customers. Information on the Site is subject to change without notice. We make reasonable efforts to keep content accurate but do not guarantee that all information is current or error-free.
All estimates provided by Peru Concrete are based on the information available at the time of assessment. Estimates are not binding contracts. Final pricing is confirmed in a written proposal prior to the start of work.
Estimates may change if site conditions differ materially from what was observed during the initial assessment, if the scope of work is modified by the customer, if unforeseen subsurface conditions are encountered, or if material costs change significantly between the estimate date and the project start date.
Any change to the original scope of work must be agreed upon in writing before additional work proceeds. Verbal authorizations do not constitute binding agreements for scope changes.
Project scheduling is subject to weather conditions, material availability, and crew scheduling. Concrete work cannot proceed safely in freezing temperatures or during certain weather events. We will notify you as soon as reasonably possible if your scheduled date needs to be changed due to weather or other conditions outside our control.
If you need to cancel or reschedule a confirmed project, please notify us as early as possible by phone or email. Cancellations made after materials have been ordered or significant preparation work has been completed may be subject to reimbursement for costs incurred.
Peru Concrete reserves the right to decline or cancel a project at any time prior to contract execution if site conditions, access, or customer requirements make the project unfeasible or unsafe.
Payment terms are stated in the written proposal provided for each project. A deposit may be required before work begins, with the balance due upon completion of the work or as otherwise specified in the proposal.
Payment is due within the time period stated on the invoice. Accounts that are not paid on time may be subject to a late payment fee. If payment is not received within a reasonable time after the due date, Peru Concrete reserves the right to pursue collection through any available legal means, including the recovery of reasonable attorney fees and collection costs where permitted by Indiana law.
Peru Concrete may file a mechanic's lien on the property in connection with any unpaid balance for labor and materials provided, as permitted under Indiana law.

Peru Concrete is not responsible for damage to underground features that were not identified or disclosed before work began. Calls to 811 (Indiana utilities notification) are the responsibility of the party who agrees to them in the written proposal.
Peru Concrete warrants that work will be performed in a workmanlike manner consistent with industry standards. Any specific warranty terms applicable to your project will be stated in your written proposal.
Concrete is a natural material that may develop minor cracking over time due to normal settling, curing, thermal expansion, and freeze-thaw cycles. The presence of minor hairline cracks does not constitute a defect in workmanship. Control joints are placed to manage cracking, but they do not eliminate all cracking entirely.
The warranty does not cover damage caused by: customer misuse or abuse; acts of nature including flooding, frost heave, or ground movement; damage from trees, roots, or encroaching vegetation; use of de-icing chemicals not recommended for concrete; or work performed on the concrete by parties other than Peru Concrete after project completion.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, PERU CONCRETE MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, BEYOND THOSE STATED IN YOUR WRITTEN PROPOSAL.
To the fullest extent permitted by Indiana law, Peru Concrete's total liability to you for any claim arising out of or related to our services or this Site shall not exceed the total amount paid by you for the specific services giving rise to the claim.
In no event shall Peru Concrete be liable for any indirect, incidental, special, or consequential damages, including loss of use, loss of revenue, or loss of goodwill, even if we have been advised of the possibility of such damages.
All content on this Site, including text, images, graphics, and the Peru Concrete name and logo, is the property of Peru Concrete and may not be copied, reproduced, or used without our prior written permission. You may view and print pages from the Site for your own personal, non-commercial use.
If a dispute arises between you and Peru Concrete relating to our services or these Terms, we ask that you contact us first at the email or phone number below to try to resolve the matter informally. Most concerns can be resolved quickly with a direct conversation.
If informal resolution is not possible, disputes shall be resolved through binding arbitration in Peru, IN, in accordance with the rules of the American Arbitration Association, unless both parties agree in writing to a different process. Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm.
These Terms and any disputes arising under them are governed by the laws of the State of Indiana, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in Indiana for any matters not subject to arbitration under these Terms.
We may update these Terms and Conditions at any time. Changes take effect when posted to this page with an updated effective date. Your continued use of the Site or our services after changes are posted constitutes your acceptance of the revised Terms. We recommend checking this page periodically for updates.
